Vivimate™ respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy toward copyright infringement.
Safe Harbor Provision
Vivimate qualifies as a "Service Provider" under the OCILLA safe harbor provisions. As we do not have direct control over the content hosted on external servers, we cannot remove content from the source. However, we will respond to valid notices of alleged infringement by disabling access to disputed links through our platform.
How to File a Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with a written communication containing the following information:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
- A description of the copyrighted work that you claim has been infringed.
- The specific URL or location within our Subscription Service where the material is located.
- Your address, telephone number, and email address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Counter-Notification
If you believe that material you posted was removed by mistake or misidentification, you may file a counter-notification with us. Upon receipt, we may send a copy of the counter-notice to the original complaining party. Please note that Vivimate terminates the accounts of repeat infringers in appropriate circumstances.
